DMCA Policy

1. INTRODUCTION AlphaTwelve ("Company," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using the Anybody application or related services (the "Service"). 2. REPORTING COPYRIGHT INFRINGEMENT If you believe that your copyrighted work has been copied and is accessible on the Service in a way that constitutes copyright infringement, please provide our designated Copyright Agent with the following information: a. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf. b. Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works. c. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Please provide the specific URL or description of where the material is located within the Service. d. Your contact information, including your name, address, telephone number, and email address. e. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. f. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner. 3. COUNTER-NOTIFICATION If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Copyright Agent with the following information: a. Your physical or electronic signature. b. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled. c. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled. d. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside of the United States, for any judicial district in which the Company may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person. 5. PROCEDURES 5.1. Upon receipt of a valid DMCA notification, we will: a. Remove or disable access to the allegedly infringing material. b. Notify the user who posted the material that it has been removed or disabled. c. Provide the user with a copy of the DMCA notification and information about how to submit a counter-notification. 5.2. Upon receipt of a valid counter-notification, we will: a. Provide the original complainant with a copy of the counter-notification. b. Inform the original complainant that we will restore the removed material within 10 to 14 business days unless the original complainant files a court action against the user. c. Restore the material within 10 to 14 business days after receiving the counter-notification, unless we receive notice that the original complainant has filed a court action. 6. REPEAT INFRINGERS 6.1. In accordance with the DMCA, we will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances. 6.2. We reserve the right to terminate any user's account if the user is determined to have infringed the copyrights of others, regardless of whether there is any repeat infringement. 7. GOOD FAITH 7.1. Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. 7.2.
